Terms and Conditions

These terms and conditions shall apply to all transactions between Metalscape Pty Ltd and any person, firm or company (“the Purchaser”) placing an order with Metalscape for the supply of Signs, Artwork and Gifts. Metalscape agrees to sell and the Purchaser agrees to purchase the metalwork at the price stated and on the sole basis of the terms and conditions of Metalscape stated herein. 

1. Ordering 
Please provide clear delivery details with a contact phone number to help us get your order delivered in time.  
2. Payment Complete 
Payment has to be complete before the order will be processed and delivered. If the Purchaser wishes to collect the item,  payment will need to be finalised prior to pick up. 
3. Prices 
All prices provided on this website are inclusive of a Goods and Services Tax (GST), unless explicitly stated otherwise. 
The purchase price for the products will be at our selling price on the date of our receipt and acceptance of your order, less any applicable discounts in effect at that time. 
All orders will attract a delivery charge which is determined at the checkout.

We will not be responsible for errors in pricing that appear on this website.  In the event of a pricing error, we will notify you before an order is accepted and you will have the opportunity to cancel your order.

All product details, prices, terms, conditions and other information are subject to change at any time without notice.
4. Change or cancellation of order
As we process your orders immediately for prompt delivery, we regret that cancellation or change to your order may not be possible unless we receive your request by email  within 24 hours of placing your original order. If your order is placed outside of business hours we will need the request by 9am the following business day. Any requests after this time will be at the discretion of Metalscape. 
No cancellation or change of orders will be accepted once your order is in process/completed/dispatched.
We do not refund or exchange items:
- if you decide to change your design, as most of our products are personalised
- if errors are made due to incorrect information supplied by you
5. Delivery 
If ordering standard stock items which are in stock these will be delivered within 7 -10 days.  
Metalscape will make every effort to manufacture and dispatch custom signs and orders out of stock as early as possible, however due to the nature of the work and finish these may take up to 6 - 12 weeks from placement of order to delivery. 
Please let us know if you require an item for a specific date and we can discuss options with you.
Where possible we use Australia Post - Registered Post to send our signs and artwork.  However for custom signs which exceed Australia Post limits (see Australia Post - Parcel Limits) these can be either picked up or a courier can be arranged please contact us to obtain rates.
For international postage please contact us to obtain rates.  
5.1 Delivery at home and office addresses 
We can deliver to home addresses; alternatively if it is preferable to take delivery at a work address please ensure that someone is there to sign with your authority for the delivery. 
5.2 Signature required on delivery 
When we ship your order with Australia Post or an appointed Courier, you will have to sign upon receiving your goods. Your contact number is required so that a suitable delivery time can be arranged. We recommend your workplace as the preferred shipping address 
Metalscape can not be held responsible if the proposed delivery date by Australia Post or the appointed courier is not met.

6. Payment
There are five payment options:
PayPal (PayPal offers an easy, reliable and secure service enabling you to fund your payment using your debit card,  credit card, bank account and PayPal balance). 
Credit Card over the phone by calling +61 (02) 4758 8305. We accept Visa and MasterCard only.
Direct Deposit into our account, banking details available at time of checkout. Please include your Reference Number (from order confirmation) so that we can verify where the payment has come from.
Australian Cheque or Money Order payable to Metalscape. Post to PO Box 118 Hazelbrook NSW 2779.
In person at our trade shows via Cash, Credit Card (Visa and MasterCard). 
Please note we will not process or dispatch an order until full payment is received. 
7. Customer Service
The Purchaser must inform Metalscape immediately of any problems. Complaints are taken very seriously and will be dealt with as soon as possible. 
If the goods are damaged the Purchaser must contact Metalscape within 24 hours of receipt of goods. 

7.1 Standard Products

Returned items will only be accepted if we are first notified and they are returned in the same condition as they were delivered. You will be responsible for all postage costs, unless the item is faulty or we have made a mistake with the item chosen for the delivery.   As per Australian Consume Law refunds are available for goods with major faults/defects.

Any damaged goods must be returned to Metalscape as they were received by you with packaging intact and Metalscape will access and exchange the items concerned. 

7.2 Custom \ Personalised Products
Specialised \ Custom work designs will be sent to you via email for confirmation prior to manufacture. Once we receive your confirmation via email your product will be scheduled into the next available production run. 
Custom work will not be exchanged or refunded unless the product delivered varies from the agreed proof transmitted to you via email. Contact us immediately upon receipt to discuss.
8. Product Descriptions
Images displayed on this website are for illustrative purposes only.  Actual colour can vary for a particular product as this can depend on your personal computer settings.
9. Force Majeure 
Metalscape will exercise every reasonable effort to meet the earliest dispatch date. Metalscape shall not, however, be liable for any loss or damage due to delays or failure to ship orders resulting from any cause beyond its reasonable control. Causes such as but not limited to securing necessary export licenses, compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

Collection of Information
In order to use the Metalscape website, we may require information from you in order to provide the best service possible.We are required to treat certain information collected from you as confidential according to the National Privacy Act. All correspondence may also be collected and stored, particularly in regard to sales, support and accounts, including Email. Any information collected by Metalscape is collected via correspondence from you or your company. This may be via the telephone, Email, mail, fax or directly through our website. 

Use of Collection Information
Any details collected from Metalscape customers is required in order to provide you with our products and/or services, and customer service. Correspondence is recorded in order to provide service references, and to assist in our staff development.

Storage of Collected Information
The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

Access to Collected Information
If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by accessing your account via our website metalscape.com.au or emailing us at office@metalscape.com.au

If you purchase a product or service from us, we may request certain personally identifiable information from you. You may be required to provide contact information (such as name, Email, and postal address) and financial information (such as credit card number, expiration date).

We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

Metalscape uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists by emailing us at office@metalscape.com.au

You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.

Third Parties
Metalscape may at its discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. 

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Metalscape does not share any information with third parties for any unknown or unrelated uses.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.

The terms and conditions set out in this privacy statement only cover the domain name of metalscape.com.au.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

12. Other information
Metalscape is an Australian based and owned business. We operate out of the Blue Mountains NSW Australia. All currency is in Australian Dollars AUD. All designs developed by Metalscape remain the exclusive property of Metalscape unless otherwise agreed in writing.

13. Gift Certificate Information

Purchasing a Gift Certificate:
- Our Certificates are available via the website up to $500.00 For any larger amount please contact us and we will arrange this with you over the phone.
- Certificates can be delivered to either you or the recipient directly

Redeeming a Gift Certificate:
- Recipients can reddem their Gift Certificate by browsing and making their purchase online
- During the checkout process there will be an option to redeem your Gift Certificate. If this option is chosen you must supply your first name, surname and certificate/voucher number in the boxes provided for it to be accepted.
 - The balance of the voucher will be applied to the shopping cart total. If your order exceeds the amount of the gift certificate, you must pay the balance via one of our excpeted payment methods. Any unused balance will be placed in the recipent's gift certificate account for later use, this is not transferable.

Gift Certificate Terms and Conditions:
The same exchange and return policies apply for any purchase made with a gift certificate.
- No gift certificates may be redeemed for cash, nore will any refunds be given for returns or unredeemed or expired gift certificates.
- Gift certificate are valid for 12 months from the issue date and are recorded for verification
- Metalscape will not be liable for gift certificate that are lost or stolen.
